  • What is Bankruptcy?

    Bankruptcy is protection extended to you from the US Bankruptcy Court. There are different chapters of bankruptcy. The most common chapters for consumers are Chapters 7 and 13.

    Chapter 7 Bankruptcy 

    Chapter 7 is the most common form of bankruptcy filed. You must qualify for Chapter 7 based on your income, family size, and other factors. When a Debtor(s) files for Chapter 7 relief, he/she (or "it" since a company can file for Chapter 7) is usually seeking a Discharge Order from the bankruptcy court, which orders the Debtor(s) no longer responsible for certain debts. The most common debts that are discharged in Chapter 7 are: credit card debt, medical debt, personal loans, deficiencies on foreclosed homes, deficiencies on repossessed vehicles, certain tax debts, and other unsecured debts.

    Chapter 13 Bankruptcy

    Chapter 13 bankruptcy is similar to a restructuring or payment plan whereby you pay some of your debt back, and discharge some of it as well. There are huge benefits to Chapter 13.
